It is a settled rule of international law that a State may not rely on the provisions of its 'internal law' as justification for failing to comply with international obligations. However, the judiciaries of most countries, including those with a high record of compliance with international norms, have increasingly felt the need to preserve the area of fundamental principles, where the State's inclination to retain full sovereignty seems to act as an unbreakable 'counter-limit' to the limitations deriving from international law. This volume explores this trend by adopting a comparative perspective, addressing the question of how conflicts between international law and national fundamental principles are dealt with and resolved within a specific legal system. The contributing authors identify common tendencies and fundamental differences in the approaches and evaluate the implications of this practice for the future of the principle of supremacy of international law.

This text explores how the public purpose doctrine reconciles the often conflicting, but equally binding, obligations that states have to engage in regulatory sovereignty while honoring host-state obligations to protect foreign investment. The work examines the multiple permutations and iterations of the public purpose doctrine and concludes that this principle needs to be reconceptualized to meet the imperatives of economic globalization and of a new paradigm of sovereignty that is based on the interdependence, and not independence, of states. It contends that the historical expression of the public purpose doctrine in customary and conventional international law is fraught with fundamental flaws that, if not corrected, will give rise to disparities in the relationship between investors and states, asymmetries with respect to industrialized nations and developing states, and, ultimately, process legitimacy concerns.

Il n’est pas rare, aujourd’hui, qu'une place soit faite, lors de colloques, à de jeunes docteurs voire à des doctorants. Et après tout, qui, mieux que des chercheurs engagés dans le traitement de leur sujet de thèse ou en ayant récemment terminé avec lui, peuvent, à l’intention du public, en cerner les contours et en préciser les axes essentiels ? Les travaux qui sont ici publiés se singularisent dans la mesure où ils sont le fruit d’une initiative venant de doctorants eux-mêmes, qui ont ensuite entièrement assumé la charge de l’organisation et du bon déroulement du colloque qui s’est tenu le 7 février 2006. Le thème retenu est, en outre, de nature à retenir l’attention. Certes il n’apparaît pas neuf, tant la problématique de l’influence de la construction européenne sur les droits nationaux des États membres de l’Union est à la fois ancienne et permanente. Mais précisément, son actualité est constante et le besoin se fait toujours sentir, à intervalles périodiques, de dresser des bilans et de dégager des perspectives. Les interventions de ce colloque se signalent par leur variété et leur complémentarité. D’abord parce que les branches du droit sur lesquels elles portent sont multiples : le droit international, le droit constitutionnel, le droit des libertés publiques, le droit administratif, le droit pénal, le droit civil sont tour à tour abordés, sous forme soit d’études de “grand angle”, soit de recherches focalisées sur tel aspect particulier. Ensuite parce que les diverses méthodes d’action du droit communautaire sur les droits nationaux sont successivement illustrées. Enfin, parce que les différents modes d’influence du droit de l’Union sur les droits de ses États membres, qui vont de la diffusion insensible à la remise en cause ouverte, se trouvent bien mis en évidence.
